1. Agreement to Terms
By accessing or using CastorGrid ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not access or use the Service. These Terms constitute a legally binding agreement between you and CastorGrid.
2. Description of Service
CastorGrid is a cloud-based construction project management platform that allows users to manage projects, job logs, schedules, time tracking, purchase orders, and client communications. We reserve the right to modify, suspend, or discontinue the Service at any time.
3. User Accounts
To use certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information and promptly update any changes. You must be at least 18 years old to create an account.
4. Subscription and Payments
CastorGrid offers both free and paid subscription plans. Paid subscriptions are billed in advance on a monthly or annual basis through our payment processor, Paddle. All fees are non-refundable except as expressly provided in our Refund Policy or required by law. You are responsible for all applicable taxes.
5. Acceptable Use
You agree not to:
- Use the Service for any illegal purpose or in violation of any laws
- Interfere with or disrupt the Service or servers connected to the Service
- Attempt to gain unauthorized access to any portion of the Service
- Upload or transmit viruses, malware, or other harmful code
- Harass, abuse, or harm another person using the Service
- Reverse engineer, decompile, or disassemble any aspect of the Service
6. Intellectual Property
The Service and its original content, features, and functionality are owned by CastorGrid and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of any content you upload to the Service. By uploading content, you grant us a license to use, store, and process it solely for the purpose of providing the Service to you.
7. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Service, you consent to the practices described in the Privacy Policy.
8. Termination
We may suspend or terminate your account and access to the Service at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive.
9. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free. You use the Service at your own risk.
10. Limitation of Liability
To the maximum extent permitted by law, CastorGrid shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service. Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Costa Rica, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Costa Rica.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
